Terms

Buyer and Seller Terms: an outline.

This page outlines how buying and selling on Curated Hammer will work. It is not a contract. Final terms, with every number filled in, will be published before launch.

Draft — final before launch

Buyer terms (outline)

  • Your bid is binding. A winning bid in a live or timed auction, or an accepted offer, forms a contract to buy the lot.
  • All-in price before you bid. Each lot shows the hammer or asking price, the buyer’s premium, an estimate of tax, and a shipping quote before you commit.
  • Payment into escrow. Funds are held in escrow until delivery, then released after an inspection window, unless you open a dispute. The exact window will be published in our Buyer Terms before launch.
  • Condition reports. Every lot carries a written condition report. If the piece arrives materially different from its report, open a dispute within the inspection window.
  • Disputes. While a dispute is open, funds stay in escrow. The dispute process and timelines will be set out in the final terms.
  • Taxes and duties. Sales tax, VAT, import duties and any export licences depend on where the piece ships. They are shown before checkout wherever we can calculate them.

Seller terms (outline)

  • Vetted sellers only. Dealers, galleries and auction houses apply and are reviewed before listing.
  • Accurate descriptions. Sellers warrant attribution, condition and provenance as described, and must disclose restoration and known title issues.
  • Provenance and compliance. Sellers are responsible for lawful title and for complying with cultural-property, ivory, CITES and sanctions rules that apply to the object.
  • Payouts. Funds are held in escrow until delivery, then released after an inspection window, unless you open a dispute. Sellers are paid after funds are released.
  • Commission. Commission tiers will be published on our Fees page before launch.
